These Financial Regulations were adopted by the Council at its Meeting held on 16/3/2015 minute 164/1415

 

      Dispensations Granted

Finance Minute 141/1213 (c) 

(a) “Lawford Parish Council grants it’s councillors, elected or co-opted, a General Dispensation from restrictions imposed by Section 31(1) and 31(4) of the Localism Act 2011, enabling members with beneficial interests in land within the administrative area of Lawford to participate and vote on issues related to the items listed in (b) under the Local Government Finance Act 1992. 
(b) That the dispensations referred to above relate to all or any of the following matters: 
·Setting Council Tax or a precept under the Local Government Finance Act 1992 
·Any allowance, payment, pension or indemnity given to councillors 
·Any ceremonial honour given to councillors.
This General Dispensation shall remain in force until the next Parish Council elections in May 2015.
This Dispensation is granted under section 33(2)(a) of the Localism Act 2011, on the grounds that without the dispensation each member of the Parish Council would be prohibited from participating in any of the business listed below. Lawford Parish Council is empowered to grant this Dispensation as a Relevant Authority as defined in section 27(6)(d) of the Localism Act 2011.”
This was proposed by Mr C Guglielmi, seconded Mr B Rolfe voted and agreed.
 
Planning Minute 142/1213 (c)
 
“Lawford Parish Council grants it’s councillors, elected or co-opted, a General Dispensation from restrictions imposed by Section 31(1) and 31(4) of the Localism Act 2011, enabling members with beneficial interests in land within the administrative area of Lawford to participate and vote on issues relating to the parish of Lawford where barring them from participating in the relevant business would impede the transaction of that business.
a)That the dispensations referred to above relate to all or any of the following matters: 
·Any planning matters relating to the whole or part of the Tendring District on which the parish council has been consulted or wishes and, without detracting from the scope of this 
·Applications for planning permission (including proposed developments and supermarkets), reserved matters approval, listed building consent, conservation area consent, advertisement consent, hazardous substances consent, proposed or potential enforcement action or the proposed or potential confirmation of any tree preservation order 
·Any proposed local plan policy, statement or land allocation 
·Any other matters which fall within the functions delegated to the Planning Department of Tendring District Council.
This General Dispensation shall remain in force until the next Parish Council elections in May 2015.
