Minutes of the Meeting of the Council held on 1 October 2007 at the Church Room, Chapel Cut, Mistley. Present: - Cllrs Fairhall (Vice Chair in the Chair), Forrester, G Carter, Peacock, Rayner, Thompson and Worsley R Ling (Clerk to the Council) 12 Members of the Public Press Apologies Cllr J Carter, French, Horlock and Rose. Police and District Cllrs Dew and Guglielmi 83.07 Declarations of Interest Cllrs G Carter and Peacock declared a personal interest in item 9 of the Agenda (Village Hall) 84.07 Minutes of the Previous Meeting The minutes of the previous meeting held on 20th August 2007 were agreed as a correct record and signed by the Chairman. Proposed Cllr Peacock 85.07 Matters Arising a. AFFORDABLE HOUSING The Clerk reported that questionnaires had been delivered to every property in the parish and were due back to the Rural Community Council of Essex by 16th October. Delivery costs were £100.00 plus VAT. This was noted. b. FEEDING OF BIRDS along The Walls. Letters expressing the Council’s concern about this practice had been sent to TDC and Swan Watch and had been circulated to all Members. Replies had been received from Swan Watch and TDC, which had also been circulated. TDC are seeking a meeting with Swan Watch to discuss the situation and the matter was therefore deferred until the result of that meeting was known. c. Letter from Cllr D Lines, Leader of TDC, following his attendance at the last meeting was circulated and noted. d. FURZE HILL RECREATION GROUND The Clerk was instructed to seek a legal opinion from E.A.L.C. on the process and the pros and cons of declaring Furze Hill “Common Land” Proposed Cllr Rayner 86.07 Public Voice The meeting was adjoined from 7.40 p.m. until 8.00 p.m. to allow members of the public to speak. Matters raised were (1) reports on liaison meetings with the POLICE (2) report from D/C Guglielmi regarding various matters including proposals for a SIGN TO KILN LANE CAR PARK (3) report from Cllrs Rayner and Thompson regarding a meeting of the ESSEX FORUM (4) PROBLEM OF LORRIES QUEUING to enter Mistley Quay (5) SPEED OF TRAFFIC in Clacton Road and its use by HGVs and (6) request to MOVE POSTS ON THE GREEN further onto the greensward to allow more space for cars to park. 87.07 Action taken under Public Voice a. With regard to (3) the Council has to be ready to respond to the proposed consultation regarding the possible closure of RURAL POST OFFICES and to support the retention of the High Street Post Office (4) the Clerk was asked to take this up with the Police (5) the Clerk was instructed to take this up with the Police and ECC and (6) Clerk to obtain quotation and report to next meeting. 88.07 Finance a. The following direct debits and standing orders were noted: £653.00 (salaries) b. A request for a grant to the Stour Rotary Club to sponsor an event in the forthcoming Young Musician of the Year Competition was approved in the sum of £70.00. Proposed Cllr Fairhall c. The report from the External Auditor on the 2006/07 Accounts had been circulated and no action was deemed necessary. 89.07 SKATE BOARD SITE The Clerk had circulated an e.mail from D/C Dew regarding the continued hire of skate board equipment at Furze Hill Recreation Ground. It was agreed that the Council would give permission for the use of its land for a further period of hire and would contribute another grant of £600 to allow this to happen. However the Council would not agree to the equipment becoming permanent and/or taking over its ownership unless a legal agreement was drawn up between all parties concerned to share the cost of insurance, maintenance, repair, improvements etc and that Cllr Dew be so informed. 90.07 DOG BINS The Clerk reported a letter from TDC stating that a dog bin had been provided along Mistley Place Walk off New Road. He was requested to ask for two further bins (1) in New Road at the entrance to the Welcome Home Field and (2) in Harwich Road near the footpath to Stourview Avenue. 91.07 VILLAGE HALL A letter from the Mistley United Football Club, and comments on it by Cllr J Carter, had been circulated to all Members regarding the future management and funding of the Village Hall. It was agreed that a meeting should be arranged between the Football Club and the Hall Management Committee and the Clerk would then invite all Councillors to attend. Proposed Cllr Peacock 92.07 Suffolk Coast and Heath Area of Outstanding Natural Beauty The Clerk Had reported that a meeting was to take place at Wrabness Village Hall to discuss a draft management plan. 93.07 MANNINGTREE AND DISTRICT OFFICIAL GUIDE An e.mail had been received from Manningtree Town Council requesting a representative from the Council to assist in the production of an Official Guide for the area. Cllr Worsley agreed to represent the Council. 94.07 Tendring District Association of Local Councils T.D.A.L.C. had written asking what support there would be for training of Councillors to take place locally. The Clerk was asked to reply that there would be limited support in some topics. 95.07 Planning Recent planning decisions made by TDC since the last meeting were noted 96.07 Correspondence Recent correspondence was reported and the following decision made:- The Colchester Cycling Club would be allowed to use Furze Hill Recreation Ground on 11th November 2007 and 20th January 2008 provided no activity took place during the two minutes silence on Remembrance Sunday. 97.07 Date of next Meeting Tuesday 13th November 2007 at the Church Room, Chapel Cut Meeting closed at 8.55 p.m. Signed............................
